Welcome to chopexpressapp.com, a proprietary website/application of Chop Express ("Chop Express", "we", "us"). By accessing this Platform, you ("User", "you", "your") agree to these terms and conditions. If you do not understand any of the terms of this agreement, please contact us at support@chopexpressapp.com.

1. General Terms

1. These terms of use govern the use of our website and mobile application (collectively the “Platform”) and define the legally binding terms on which you access, browse, register or otherwise use the Platform to enjoy our services. The terms apply to all "Users" of the Platform including guest Users.


2. By using our Platform in any manner, you confirm that you accept these terms of use and that you agree to comply with and be bound by them.


3. You understand that a breach of any of these terms may result in your rights to use the services on the Platform being restricted, suspended or withdrawn.


4. We may amend these terms at any time by updating this page. Existing Users will be informed of material amendments via an in-app prompt where appropriate. Please check this page periodically.


5. If you do not agree to these terms, please do not access this Platform or use the services.

2. Services

1. This Platform allows Users to request one of our Chop Express to order or pick up food, grocery items, over-the-counter drugs, medical consumables, and other over-the-counter health-related products ("OTC Pharmaceuticals") from nearby restaurants, supermarkets and pharmacies ("Services").


2. The Platform lists a variety of restaurants, supermarkets and pharmacies you can choose from to order meals, grocery items and OTC Pharmaceuticals for pickup and delivery.


3. Chop Express is not affiliated with, and does not operate or employ, the restaurants, supermarkets or pharmacies listed. We act as a technology platform and intermediary that facilitates requests and purchases on your behalf.


4. We do not guarantee the existence, quality or safety of items listed by Vendors, nor the truth or accuracy of Vendor descriptions. We disclaim any warranty for the fitness, quality or safety of OTC Pharmaceuticals or other items provided by Vendors to the fullest extent permitted by law.

3. Accessing our Platform and the Services

1. We do not guarantee that our Platform or Services will always be available, uninterrupted or fault-free. We will not be liable to any User if the Platform is unavailable at any time or for any period.


2. We do not guarantee that our Platform or any content on it will be free from errors or omissions.


3. You are responsible for arranging and maintaining access to our Platform and for ensuring persons who access the Platform via your account are aware of and comply with these terms.

4. Membership and Registration

1. Eligibility: Services are available only to individuals 18 years or older who can form legally binding contracts.


2. Account creation requires a full name, email address, telephone number and delivery address. A one-time password (OTP) will be issued at signup and you will be required to confirm acceptance of these terms and our Privacy Policy.


3. You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. Report theft, loss or unauthorized use immediately to support@chopexpressapp.com.


4. After creating an account you may select Vendors, place orders, and request delivery by a Chop Express to your registered address.


5. We may require you to change your password or take other steps if we suspect a security breach. Failure to comply may result in account suspension or deletion.


6. User obligations:
   1. All account information must be accurate, up-to-date and truthful;
   2. You must update account information promptly when it changes;
   3. You accept responsibility for consequences arising from inaccurate or outdated information.


7. We may verify the information you provide and request additional documentation to confirm identity.


8. You may terminate your account at any time; upon termination your details will be deleted in accordance with our retention policies and applicable law.

5. Payment

1. All payments on the Platform are processed by third-party payment processors.


2. Accepted payment methods include:
   1. Closed-loop electronic wallet on the Platform (top-up required);
   2. Bank transfer;
   3. Additional methods provided by payment partners from time to time.


3. The payment processor is solely responsible for payment transactions.


4. Prices shown are in Naira and include applicable taxes where indicated. Delivery fees are shown at checkout and the total price is due when an order is placed.


5. If a price changes after placing an order, you will be notified and must accept the updated price to proceed.


6. By creating an account you agree to be bound by these payment terms.

6. Intellectual Property

1. Chop Express and our partners own all intellectual property rights in the Platform and its contents. You may use materials only for personal use and may not copy, reproduce, modify or distribute them without our permission.


2. Unauthorized reverse engineering, decompiling, or reproduction is prohibited and may lead to legal action.


3. If you believe content on the Platform infringes your copyright, contact us at support@chopexpressapp.com.


4. Vendor-provided item descriptions (menus, product names, OTC Pharmaceutical descriptions) are supplied by Vendors. Contact us if you believe an item is inaccurately described and we will take reasonable steps to address it.

7. No Reliance

The content on the Platform is for general information only and is not advice. You acknowledge that reliance on such information is at your own risk.

8. Limitation of Liability

1. Nothing in these terms excludes liability for personal injury resulting from our negligence or for any liability that cannot be excluded by Nigerian law.


2. To the extent permitted by law, we exclude all warranties not expressly set out in these terms; we will not be liable for third-party content or linked websites.


3. Our Platform is intended for domestic and private use only. We are not liable for loss of profit or business opportunity arising from unauthorized commercial use.


4. To the extent permitted by law, Chop Express will not be liable for indirect, punitive, incidental, special or exemplary damages arising out of your use of the Services.


5. We are not liable for damages arising from unauthorized use, tampering, or access to your account.


6. Chop Express is not liable for damages or losses resulting from:
   1. Delays or disruptions in Services, software, or the Platform;
   2. Your inability to use or access the Services;
   3. Suspension or other actions taken against your account;
   4. Errors, inaccuracies, losses or omissions in data provided to us;
   5. Viruses or other harmful materials that may infect devices due to use of the Platform or linked websites.


7. We will not be liable for any loss or damage arising in connection with use of or inability to use our Platform, whether in contract, tort (including negligence) or otherwise, even if foreseeable.

9. Indemnification

1. You agree to indemnify, defend and hold Chop Express harmless against any loss, damage, liability and claim arising out of:
   1. Your use or misuse of our Services;
   2. Your use or misuse of OTC Pharmaceuticals delivered;
   3. Your breach of these terms or applicable law.


2. We may assume the exclusive defence and control of any matter for which you must indemnify us, at your expense, and you agree to cooperate.

10. Term and Termination

These terms become effective when you start using our Services and continue until terminated by you (by closing your account) or by us.

11. Restricted Activities

1. Use the Platform only for lawful purposes. Do not permit others to use it for purposes other than intended.


2. You must not:
   1. Breach any applicable law or regulation;
   2. Use the Platform in an unauthorised or detrimental manner;
   3. Use the Platform for fraudulent acts (including false identification);
   4. Modify, adapt, decipher, disassemble or reverse engineer any software forming part of the Platform.

12. Electronic Communication

1. By using our Services you consent to receiving electronic communications (emails, in-app notices) which satisfy legal requirements for written communications.


2. You agree to the use of electronic signatures and records and waive any requirement for original handwritten signatures or paper records to the extent permitted by law.

13. Severability

If any provision of these terms is held invalid, unlawful or unenforceable, it will be severed and the remaining provisions will continue in full force.

14. Personal Data

We collect and process Users' personal data. For details on how we handle personal data, please read our Privacy Policy. We only share your information as described in the Privacy Policy and as required to fulfil your order.

15. Sanctions for Breaches

1. In the event of fraud, breach or violation of applicable laws, we may:
   1. Suspend or terminate access to all or part of the services for the offending User; or
   2. Alert relevant authorities and take legal action.


2. Any suspension or termination takes effect when we send the communication to the User; the account may be deleted without further notice.

16. Placing Orders

1. Product images may be illustrative stock photographs and may not be exact representations.


2. All order pages and communications will be in English. Review your order before confirmation; the checkout page allows corrections prior to confirming an order.


3. To place an order, select a Vendor and items from the lists provided on the Platform.


4. If a desired Vendor is not listed, you may request a listing but we are not obliged to add them.


5. Order confirmation constitutes an offer to contract. Cancellation must occur before the Vendor accepts the order.


6. The Platform provides an order summary and payment history accessible at any time.

17. Delivery of Your Order

1. Delivery is executed between you and Chop Express (via our delivery partners).


2. You must take delivery of items ordered through the Platform.


3. If items are missing, contact Chop Express customer service immediately at support@chopexpressapp.com and we will investigate and, where appropriate, refund the undelivered amount.


4. Failure to take delivery does not entitle you automatically to a refund or delayed delivery unless otherwise agreed.


5. Ensure delivery details (address and phone number) are accurate. Inaccurate details may lead to failed delivery.


6. For inaccurate or mixed-up orders you must contact Chop Express immediately and request a return. Do not tamper with delivered items in a way that makes return impracticable.

18. Complaints

Submit complaints to customer service via support@chopexpressapp.com or the in-app chat.

19. Disclaimer

1. Services are provided "As Is" and "As Available". Chop Express disclaims all warranties not expressly set out here. We do not guarantee relationships with Vendors listed on the Platform.


2. We are not medical practitioners. Our Services are limited to delivery of OTC Pharmaceuticals and do not include medical advice, diagnoses, or healthcare services.


3. We do not deliver prescription drugs that require a doctor's prescription.

20. Promotional Codes

Chop Express may issue promotional codes ("Promo Codes") redeemable for discounts or benefits subject to the following rules:

1. Promo Codes must be used lawfully and for their intended purpose;


2. Promo Codes may not be duplicated, sold, transferred, or publicly posted;


3. Chop Express may disable Promo Codes at any time without liability;


4. Promo Codes are subject to specific terms established for each code;


5. Promo Codes are not redeemable for cash;


6. Promo Codes may expire before use;


7. Chop Express may withhold or deduct credits obtained via Promo Codes if we determine they were used in error, fraudulently or in violation of these terms.

21. Governing Law

These terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be subject to the exclusive jurisdiction of the Nigerian courts.
